Drop Down Menu not accessible in call

Using HTC Incredible and when I am in a call and receive a text or some other notification, I cannot drag the top menu bar down. Anyone else running into this issue?

I also have this issue on my incredible. In order to get around it I hit the home button then pull down the notification bar. Not ideal but I can live with it for now
